Just read excerpts of AP High Court judgement on Amway scam

It is apt to republish some of the caustic comments by the Andhra Pradesh High Court regarding the business model of Amway India for the convenience of Nikhil Bhatia who refuse to read the old posts to go through the judgement.

        Each member on his enrollment pays Rs.4,400/-.  Payment of Rs.4,400/- by a member on his enrollment and his future earnings through marketing/enrolling other members constitutes event or contingency relative to his enrollment.  The distributor gets all this money as a consideration for promise made by the sponsor at the time of his enrollment.  Thus as far as the member joining the scheme is concerned, both the ingredients of Section 2(c) of the Act, i.e., a) making of quick or easy money, and b) the chance or opportunity of making quick or easy money depending on an event or contingency relative or applicable to the enrollment of members into the scheme are satisfied (Para 31). 
     As pleaded by the petitioners themselves, out of Rs.4,400/- a substantial part, namely Rs.1,800/- is collected as subscription fee, license fee, business kit etc.  To qualify for earning commission a member has to earn the minimum monthly PV of 50 which he will get by selling products worth Rs.2,000/-.  Respondent No.6 in para-11(c) of his counter affidavit specifically pleaded that  “Amway” (First petitioner) would automatically get a business of the quantum of Rs.1080/- crores (4,50,000 x 2,000 x 12(months) ) per annum which would yield an astronomical profit and it cannot but be stated as “easy/quick money” without any service to the distributors/members irrespective of whether they sell the products or not, though the company may conveniently refer it as “turnover by sale of products”.  Significantly, this assertion made in the counter affidavit is not denied in the rejoinder of the petitioners. They have merely tried to explain the said allegation by offering certain justifications.  The petitioners have not specifically denied that the first petitioner would get a sum of Rs.1,080/- crores by ensuring that each distributor maintains the minimum sales level.  Even though the scheme per se does not stipulate that each distributor has to maintain the minimum required business level, prescription of minimum level of 50 PV to qualify for getting commission is sufficient inducement for the members to relentlessly strive for maintaining the PV level at or above the said minimum levels.  (Para 33).
       It is, thus, evident that the whole scheme is so ingeniously conceived that the inducement for aggressive enrollment of new members to earn more and more commission is inherent in the scheme.  By holding out attractive commission on the business turned out by the downline members, the scheme provides for sufficient inducements for its members to chase for the new members in their hot pursuit to make quick/easy money.  On the part of the promoter by pushing each member to achieve the minimum sales worth Rs.2,000/- per month, (this sale includes enrollment of new members) he is assured of about 1000 crores per annum.  All this squarely satisfy the description of quick/easy money.  In addition to this, it is an admitted fact that each person in order to continue to be the distributor, shall pay renewal subscription fee of Rs.995/- per annum.  In para-11(b) of the counter affidavit on the admitted number of distributors of  4,50,000 this amount is calculated at about Rs.45 crores per annum.  These figures are not denied by the first petitioner in its rejoinder.  The plea of the first petitioner that there is no compulsion that a member shall renew his distributorship looks to us to be specious.  Once a person becomes a distributor in a scheme of this nature where the sops in the shape of commission are so luring, it would be very difficult for a member to withdraw from their membership to avoid payment of the annual renewal subscription fee. (Para 34).
                From the whole analysis of the scheme and the way in which it is structured it is quite apparent that once a person gets into this scheme he will find it difficult to come out of the web and it becomes a vicious circle for him.  In any event the petitioners have not specifically denied the turnover they are achieving and the income they are earning towards the initial enrollment of the distributors, the renewal subscription fee and the minimum sales being achieved by the distributors as alleged in the counter affidavit.  By no means can it be said that the money which the first petitioner is earning is not the quick/easy money.  By promising payment of commission on the business turned out by the down-line members sponsored either directly or indirectly by the up-line members (which constitutes an event or contingency relative to enrollment of members), the first petitioner is earning quick/easy money from its distributors, apart from ensuring its distributor earn quick/easy money.   Thus the two ingredients are satisfied in the case of promoter too. We are, therefore, of the considered view that the scheme run by the petitioners squarely attracts the definition of “Money Circulation Scheme” as provided in Section 2(c) of the Act. (Para 35).
Nikhil might argue that now Amway India is collecting only Rs. 995 as entrance fee but the 6-4-3 scheme is still there. Let us hope this would bring some awareness in him.

Ok now lets talk business

1) Why are you talking about Rs2000 again and again. I will personally show you my account and then you will come to know it is not mandatory to do Rs2000 every month. It is your choice. I buy products as per my usage.

2) WHy are you calling Rs2000 as money circulation? If I buy Rs2000 worth of Razors what's the big problem in that? It's not money circulation and I am getting what I am paying for. Money circulation actually exists in speakasiaonline where if I refer people I will get Rs1000 for each referral. If I am paying money to buy products I do not call that Rs2000 money circulation.

3) Rs995 is fees. If today you want to open a franchise of some popular product other than Amway you have to given them money. You have to give money to CafeCoffeeDay, Mc Donald, Pizza Hut etc...only then they will give you license to sell their products. So if I have to give Rs995 I do not see any problem with that. In any franchise concept in the world you have to take license by giving money. I do not see that as money circulation.

If today I have a company and a nice product and a person comes up to me who wants to make profit out of my business; I will too charge him license fees. Why will I give my product license free of cost?

And you already know that with Rs995 you get business kit + 20% discount on all products.

Till now I do not see any validity in Court's Decision.

And that point of yours is completely invalid which says Rs2000 is money circulation. You are buying products worth of Rs2000. Amway is not taking Rs2000 and asking you to invest and that you will only get Rs2000 back if you build your tree. You are buying products.

Here are the list of few products that are damn cheap and you can compare with other products of same price in market.

If I buy these products for Rs2000; I don't understand why are you calling it money circulation.

Now tell me if I but a Gillete razor then it will cost me Rs16; Amway is also Rs16 and above are the prices for an Amway IBO since we pay Rs995 and get 20% discount on all products which we get back very easily in a year.

Buying Gillete is not a scam but buying Amway Razor at a less price is. I simply don't get it.

I was using a Deodorant that was Rs250, Amway is only Rs174.

You should not comment without using the products and testing their quality for yourself. If you really want to comment then buy these value products and test them for yourself.

And if you do not want to spend money; I am coming to hyderabad soon; I will give you the products free of cost so that before commenting on products you atleast test them. That is my confidence in the products that is speaking not some script. I use deo and all these products myself on a daily basis; specially I love the deo.

Infact if a new person joins Amway and he does not likes the products Amway is giving 100% money back guarantee. So if you spend Rs2000 and dont like products return them to Amway and get Rs2000 back. That is the confidence we have in products.

I was also doubtful before using products; but after using them I am confident that yes products are really nice. After all my brothers and sisters are also coming with me; and I do not want to give them some bad products and then spoil my relationship. That is quite obvious and that my female relative is my massi who is only using products for 4 years but not building tree.

Here are the details of my Amway account for shopping products. You can see PV over there and I just started the business so I am not Amway HAW HAW as David says; it's a false claim from David side.

I shop according to my level; it is not that I must do Rs2000 everymonth.

For first month I bought Glister, shampoo, Shaving Creams etc. so PV is high; for the second month I am still using these products so it makes no sence to buy these again and go over Rs2000. I don't know who told you that Rs2000 is mandatory. I shop as per my usage. In March I bought things that got finished in a month like deo, soap, facewash etc..

You can see in March it is Rs723 only and in april it might be less than Rs723 since I am not going to shop until I finish these products. That is common sense.

You can see all zeroes before Feb2011 since I recently joined so I am not Amway HAW HAW as David says and I am also giving you proof. Let me come to hyderabad then I will show you everything in my account in detail.

I can understand why the business existed for 52years and will continue to exist in future.

I will ask you to completely read the Code of Ethics booklet that is provided in Amway business kit.

It clearly states you will not force anybody to use products and do a monthly PV or force anyone to only use Amway products. The IBO are free to do their PV as they like and also free to use other products.

Some non ethical people in this business start forcing people and that is where the problem starts coming.

I am not one of those Amway IBO who force people to do a certain PV.

Because of such unethical people Amway has a bad reputation today.

I have used the products myself and I love them; so David all your claims are false over here.

And if you think I am trying to lure people; no I am not. I will give you all the facts you ever need!!

Then research on Nutrilite Protein Powder to find out why it is priced exactly at Rs2441 and not less or more.

If you say a product is priced high and you are saying it without any research; then that is a wrong part on your side.
You should first research that there are multiple companies for a product in market. Some are costly; some are cheap. You wont call a non-amway costly product a scam or that it is priced high. You only have to say that to amway.

Again I will show you all the facts but I don't think it is my job; if Amway is invited to Court for highly priced products; let Amway people show the court the facts. The court never questions why sensodyne is priced high because it is not MLM; but since Amway is MLM everything that Amway does seems wrong to you people.

I tell you in truth that many of my friends who joined and quit Amway never knew the details I know in 1 month's time.

There is a BIG difference in joining the business and doing the business. People don't get knowledge and that is where 90% people quit.

Ask yourself why sensodyne is highly priced?

You get one soap for Rs10 and some for Rs40. Does that make Rs40 soap a scam? Certainly not. Amway soap is priced at Rs30.

There is a reason for every product available in the market; that why it should cost that much; and the same thing is true for Amway too.

Find the facts; the truth as you always say.

Rich DeVos could very easily sell Nutrilite without MLM and then also he would have gone billionaire and no-one would have questioned Rich DeVos. But he had a different idea; he thought why not give people a chance to sell world's first multivitamin and in the process give them back 60% of the cost that is gone in marketing.

He wanted that because of the royality income and the fact that by doing this he will give others a chance to become RICH too. He could help a common man go RICH by selling world's first multivitamin.

He did gave a choice to all of you; but the problem is that some people were unable to market Nutrilite; that is a fact; not everybody can MARKET!! and 90% people start failing.

Then some unethical people came in Amway and started tool scam in USA; this tool scam does not exist in INDIA and in my tree I have BIG people and my tree is free of this tool scam to tell you the truth. No one forces me to buy any tools and all this research I have done myself with a free and open mind.

So next time when David and Shyam you say Nutrilite is cheap which was created by a scientist and for the first time the world saw a multivitamin; I am sure you do not give your free readers this fact.

All you know is some people fail; that is why Amway is bad and that is why Nutrilite is cheap.

I tell you in truth; no court in this world can question Nutrilite quality; we have a team of doctors, scientists and phd people who are making these products.

You want to challenge a scientist who make Nutrilite; guess what you are welcome and prove in court your point.

I am 1 month into this business and I am just giving you facts.

You cannot challenge a team of research scientists who made worlds first organic multivitamin Nutrilite; you cannot call it a scam or a cheap product and compare it with synthetic products in the market.

David talks about common sense over here without telling the free readers the facts. Go and tell these facts to your experts and specially you give a visit to Nutrilite farms.

Just because 90% people fail; you call it scam. I tell you in truth 90% people will always fail; you cannot expect everybody to succeed. People quit because people like you laugh at them. I will never quit Amway because I know all facts; and when someone says Amway is a scam; most of them do not even know what Nutrilite is. THAT IS AMAZING!!

You yourself a lawyer and seeker of truth and you are saying to me that Nutrilite is cheap.

There are many people who take Nutrilite but do not build tree; simply because they know what Nutrilite stands for and they need a 20% discount on them.

I am not; and as you say people loose their Rs24000 in a year; no they have not lost anything. They have got organically grown Nutrilite. Go VISIT FARMS of Nutrilite.

They got Nutrilite or some other products from Amway and that is complete money worth it.

Products are not overpriced as you think; When you say that you give more money for products and call that money circulation and then say it's a scam; no it is not a scam.

Some products that I mentioned are cheap and are equally priced to market products available in Indian Market.

Some products that are not cheap; I have given you the reason for it.

Nobody is over pricing and doing money circulation. The strength of Amway lies in high quality products and the Nutrilite has maintained the same standards since it was first developed in 1934.

Just saying products are overpriced does not make them overpriced. Give Amway IBO the proof that Nutrilite is overpriced and what should be the cost of Nutrilite according to you.

I dont think people lost their Rs24000 by buying Amway products + they also get 20% discount on Nutrilite which others don't get.

To call it money circulation you have to tell Amway IBO and in court why products should be cheap; and that should be based on free thinking;it should not be based on the fact that 90% people cannot market Nutrilite and then say we lost our money. No you got Nutrilite as a product which is the world's first organic multivitamin and you did not lost anything. It is priced competitively.

Believe it or not; Products are not overpriced at all. It's the high quality that Nutrilite maintains.

The above money has gone in
1) Organically grown farms and maintaining them to quality standards

2) It has gone to all scientists and PhD people in Amway to create Nutrilite from plants grown in Amway Organic Farms.

3) It has gone to all employees of Amway.

That is not easy money at all. Amway has to maintain their farms; Nutrilite products high quality; give salaries to research scientists.

How can you call it easy money?

Easy money exists in speakasiaonline where simply by referring people and taking them Rs11000 from then speakasiaonline gives you Rs1000 from their Rs11000. Even if I dont fill surveys I will get money. Because of easy money it has grown to lakhs of people in 1 year.

In Amway that is not the case; it has grown to lakhs of people in a span of 52 years.

You cannot call Rs2000 easy money because you are buying products. If you call buying products easy money then everything you buy from market is easy money for those people who are giving you that product.

Don't give me petitions like that; and before proceeding further research on Amway products.

For David and Shyam some more facts for your wildest dreams.

1) In spring season Amway ties up with the following companies and sell their products through MLM marketing.

The above companies are HAPPY that Amway has increased their sales through MLM and Amway IBO are also HAPPY that they have a full ebay shop which involves products from all the well known companies of the world.

1) Buying PUMA and UCB through Amway will increase my PV and I will get my money back too

2) If I buy PUMA and UCB from showroom, then no 20% discount and no increase in PV and no money back too.

You cannot imagine what Amway is doing.

I am going to buy PUMA and UCB through Amway and get high quality products and 20% discount and in the process I increase my PV and Amway gives me money back too!!

You keep on criticizing by showing only one side of coin; I have only shown the other side of coin; and any free minded reader would understand it. I understood it and became an IBO.

Amway IBO are always happy and when David says they will lure you with your smile; now you know why we smile because we are getting the full ebay and many more brands are going to come in Amway business soon.

You cannot stop Amway from tying up with PUMA, UCB and the future brands to come.

Now I hope that David and Shyam can understand my reasons for joining Amway and why Amway IBO are always smiling and full of energy.

Soon I will start a website where I will show the other side of coin because you people are showing only one side of the coin; and then let the free readers take a choice.

Because you don't show the other side of coin the readers who read your blogs cannot think with a free mind.

Future is revolution and if every top brand is available through Amway in future and I get my money back I don't think I am doing scam and money circulation.

After all the facts I have shown the experts are going to hate Amway even more; because they were trying to hide real facts the products on which the business is built for 52 years.

But I have fallen in love with Amway and that love just continues to grow :)

The future is MLM of all top brands in world through Amway. Amway just keeps getting bigger and BIGGER.

It shows your level of understanding. I have posted the excerpts of the judgement of Andhra Pradesh High Court. It has categorically stated that the business model of Amway India is illegal. May be you are just pretending. Anyway, go through the judgement once again to to understand what the learned judges said.

Now tell me where is the problem with this business model?

1) Amway is directing selling to you and you are the consumer.

2) If some Amway IBO buys Rs 1 lakh worth of products; that is quite obvious he is not going to use for himself. He fails to market it to other people and say I am stuck up with these products and all my money is gone

3) My all future downlines I am going to give this very strict instructions not to buy in big volumes just to increase turnover because you will fail to sell this big volumes.

4) Let the business grow slowly; and buy products for your own use and that also whatever you need. It is not that you have to buy the stock for the entire year. NO YOU DONT HAVE TO DO THAT.

Now I don't see any unethical in this. My uplines are not going door to door for selling Amway products. They are using themselves and that is the BUSINESS MODEL that was started by Rich DeVos.

In this business model nobody is going to loose money.

In my tree we all are doing the same. I am at 0% level but not into any loss in buying Amway products because I have to use them for myself and not do out door to door like a salesman and if I am unable to sale; I will cry I wasted my money. NO THAT IS NOT THE BUSINESS MODEL.
