After stealing people’s money, the crooks want a law in their favour

Earlier, even if a single story was published in the press against them, people used to shy away from public and feel embarrassed.  Nowadays, the crooks have become so brazen that they are showing victory signs to the TV channel cameras while they are being arrested by the police.
More, these crooks want a law to protect them from police while they are stealing crores of rupees public money.
The hectic activity on this blog could not be missed after a criminal case was filed against NMart and suddenly a sizable number of crooks raised their ugly heads demanding refund of money from Gopal Singh Shekhawat.
Many of them knew that the chain is going to break any time but everyone wants their share of booty before it is closed. They just refuse to believe that the chain would break soon.
One reader reported from Gujarat that a criminal case was filed against Gopal Singh Shekhawat there in 2010 itself. The tactics of all these crooks is similar. They immediately file a writ petition in the respective States where police file criminal cases against them.
Look at the track record of Gopal Singh Shekhawat. He filed a writ petition in Rajastan High Court in 2010 and another writ petition in AP High Court also in 2010. Immediately, after Corporate Frauds Watch filed a criminal complaint against NMart, he filed two more writ petitions in AP High Court without mentioning the old writ petition. NMart has also chosen two more writ petitions in Bombay High Court.
Police keep quiet fearing wrath from the judiciary. And these crooks continue their looting. However, there is an elastic limit and the chain brreaks. Then they start running away from law.
That is exactly what Gopal Singh Shekhawat is doing now.
There is a demand from some quarters that a law is needed in favour of multilevel marketing. It is like thieves asking for an enactment to let them freely steal public money. When the multilevel marketing itself is illegal and a crime, how could there be a law in its favour.
The only category that is silent is that of burglars. No wonder if they too formed an association in future demanding a right to steal and an enactment in their favour.
Not surprisingly, everyone who joined such schemes knows well that the chain is going to break in near future. But everyone wants to make as much money as possible before the chain breaks and police start filing of criminal cases.
One fellow was heard saying that the management of NMart is filing a writ petition in the high court and they could continue till it is disposed of.  This is the attitude of the members of such schemes. Everyone wants easy and quick money. They do not mind to cheat their own friends and relatives to achieve that. At the same time, there are some who are carried away by the tall promises of these crooks.  In one word, the greed to get easy and quick money has been landing them in trouble.
My dear fellow humans all over world! There is nothing like easy and quick money and do not fall prey to such evil designs of these crooks.

Dear all spectators of this blog... through this blog...
Friends, we don't have any relationship or any disputes between us. But we are discussing/arguing/fighting for only one subject. That is not for only just NMart subject, but Network Marketing Subject. Other than this, please share your views & clarifications each other, so that we will get very good updates for this Network Industry.
I am from Employees family since my Grand Father. I also did Job for 1 year. So, I got practical experience of JOB. So many professionals are in my family also. I am doing my own Traditional Business since 1997 Oct 21st. From this, I got BUSINESS experience. In 2007, I unexpectedly entered into Network Marketing field. Before this, I have not good opinion on Network/Chain/MLM etc. It is god promise. I have compared with my this bad opinion versus Actual Network Marketing. And also I have spent more than 1 lack rupees for proper training to know the actual meaning of Network Marketing. After all these, finally I have decided that, If any person is ready to take proper knowledge, set EGO to zero, ready to take updates from Legal Dept Vs Network Industry, that person only will get success 100% in this industry. Success means not to run for money. Proper knowledge, good effort, satisfied life is real success.
I agree with Shyam Sundar or any xyz oppositions to this industry. Because they have not taken proper knowledge regarding this industry. This is very powerful subject more than MBA or etc. But so many people are hesitating because of bad experience. I ask my 1st question, dear Network Leaders, have you spent any amount/time to take a corporate training to get knowledge in this Network Industry? Can you judge a proper Network Company? Can you give exact definition of Network Marketing?
I saw excellent leaders in this industry. But the number is very low. That's why opposite persons like Shyam or else are telling this field as EASY MONEY/QUICK MONEY. Really we get easy money from this system? I am extremely sorry if I hurt any body not by INTENTION but IN TENTION. Please we have to update our self. Then definitely this Shyam also come into this industry if he get satisfied solutions.

Today Rajsthan Government has announced new guidelines for direct marketing companies..now we request Central Government to come up with separate governing authority for this industry, as every individual associated with direct selling is paying TDS (100% transparency),while traditional companies are cheating government while filing taxes.

From every single payout every company is deducting TDS and from more than 14 years Government is taking revenue in the form of TDS/Vat etc. from Direct selling companies, which total amount should be in thousands of corers. (Govt has no separate data of it, as under RTI act I had already asked Income Tax department about the details of total TDS deposited by direct selling companies, but government was unable to provide the data)

That s why there is need of separate governing authority for this industry to protect the consumer rights and customers from money circulating companies.. sourse

As per my experience in this regard..
1)ALWAYS JUDICIAL FINAL DECISION WILL BE IN FAVOR OF PUBLIC PROSPERITY.
2) SO MANY RULE & REGULATIONS HAVE BEEN CHANGED/UPDATED IN INDIAN CONSTITUTION.

So definitely Network Industry will accept by above departments as early.

Now, I wanted to discuss on above subject that,

3) MARKETING means, itself says as a PRODUCT MARKETING/ADVERTISE/INSPIRING TO A CUSTOMER/BUYER/CONSUMER TO PURCHASE THE PRODUCT. INTENTIONS IS TO REACH THE PRODUCT UP TO CUSTOMER.

4) SO MANY MARKETING/ADVT WAYS FOR US LIKE Through TV Advt, Radio Advt, News Paper Advt, Pamplet Advt, Door to Door Advt, Film Star Advt, Mouth to Mouth Advt.

5) In above all types of Advt systems, that company has to give bulk size amount to that Advt media. It is true to the best of every person's knowledge. Most of the persons know up to this only. THIS IS THE TRADITIONAL MARKETING WAYS SINCE 1000 of YEARS. They have NO NEED to think for another option that is Mouth to Mouth Advt.

6) In Mouth to Mouth Advt system, the intention is same as to market/advertise the product to customer. So the same bulk size amount will be given to who market/advertise the product to customer. It is not wrong. More over, a common person also get income if he advertise/market the product as per his effort even not he is a film star etc. Is it good news or not?

7) As compared to Traditional System, there is a system to distribute the product as COMPANY, MANUFACTURE DEPT, MARKETING DEPT. In this two, again VICE PRESIDENT (MFG), VP (MKTG),........ MFG Technician, Sales Executive.
This is a Chain System 100%.
In Mouth to Mouth also, Upline, Downline, Help Line, Network System Training, Product Training, Communication Skills training etc which are giving in MBA classes also are getting in this Mouth to Mouth Advt system.
Network Marketing is exact definition of Mouth to Mouth Advt System. There is nothing difference in INTENTION TO REACH THE PRODUCT to Customer.

8) But so many opponents are telling as Network Marketing is wrong. Because as per market experience, so many persons disturbed by this industry.

That's why I have taken detailed subject knowledge very seriously. Not for money. But for truth. Because, I have entered into my own business at my 21 age. Monthly turnover more than 45 lakhs. Bachelor at that time. What I have to do with plenty cash for my life? This is not the matter of Money. But for TRUTH.

Unknown said...

9) So many rejected this industry. Here, TWO SUBJECTS ARE THERE. PRODUCT & MOUTH TO MOUTH SYSTEM. THIS IS THE MAIN IMPORTANT POINT I WANTED TO SHARE WITH YOU.

10) It is very clear that, Mouth to Mouth System is not wrong. Am I correct? Yes. Its 100% correct. Then Product?

11) Yes, PRODUCT Problem. So many rejected this industry because of No Needy Product.

12) For the past, If any one Purchase a product through Mouth to Mouth Advt, in actually, he no need of that product. He purchase this not for product but to earn money. So, If he recommend the product to his relatives or etc, then only he will get benefit. Otherwise he will not get any income. Finally he will disappoint & decide as Chain link/Network/MLM is wrong. This is happened in our country since beginning.

13) I mean, the Mouth to Mouth is not wrong. But the product is wrong. That's why that person unable to convince the another person, finally he failed to sell the product. So his purchased product is no actual use for him.

14) Dear friends, IF HE GET HIS NEEDY PRODUCT WHICH HE IS PURCHASING REGULARLY FROM SOME OTHER PLACE? Means, BRANDED AS PER HIS & HIS FAMILY CHOICE ?

15) DEFINITELY He will rock. So, here two parts are there. 1st is Customer Part. If he 100% satisfied with that product (Not by force), then 2nd part is, he can promote/market/advertise/refer tell mouth to mouth as per his wish.

16)Here, he is paying for his choice product. Not paying for Network Income. It is clear. If he himself satisfied 100%, then he can promote/refer to their friends/relatives/anybody as SATISFIED PRODUCT not for NETWORK INCOME.

17) This is the difference between, to refer the product by default. Not for income. By this way, he will get income automatically from the company. This company is also getting profit on that product because of his advt. That's why only giving incentive to that person.

PRIZE CHITS & MONEY CIRCULATION SCHEME (BANNING ACT) 1978 for Chit Fund Companies, Money Circulation companies. Not for Product Oriented Companies. The above act is stating as EASY MONEY/QUICK MONEY.

In Mouth to Mouth Advt system, No body will get easy money/quick money. That's why the success ratio is only 97:3, So who work hard, he only get success. It is not for just Network Marketing. It is for every field. The above ration will increase if a Customer get His choice of Product not by force.

All above is related with Network Marketing (Mouth to Mouth Marketing).

Now finally, I wanted to explain about NMart....

1) Any customer can visit to any NMart mall, he can purchase whatever he want as per his choice of product at discount price. No any rule for his compulsory enrollment. It is very clear.

Unknown said...

2) If he satisfied with said malls, If he wish to get NMart more services like, DISCOUNTS, DOOR DELIVERY, GIFT VOUCHERS, BONUS FROM COMPANY IF HE IS LOYAL CUSTOMER, CREDIT FACILITY IN DISCOUNT RATES (NO ONE COMPANY IN THE WORLD IS GIVING CREDIT IN BELOW MRP RATE EXCEPT NMART), then he can make his registration as CUSTOMER. Not as Networker. Please remember this.
3) After getting Cash Receipt, Welcome Letter, Disclaimer, Product Voucher etc, even if he want to withdraw, he have a time upto 30 days. Is is good? or Great?
This is the actual NMart concept.

If he say about NMart advantages to customer by default, if anybody get registration because of this person, obviously company will get some extra sales/turnover/business from this customer. That's why company is paying incentive on that profit. Not SALARY. It is also customer wish. Not compulsary.

Mainly, the company intention is for REPURCHASE INCENTIVE. If any customer from your group will purchase ration/textile/electronic etc as per his wish, on the total sales, company will get some margin. Mr Gopal ji Shekhawat is not eating the total margin as so many Retail/Wholesale/Traditional Owners are growing their stomachs. This handsome person is giving some part of that margin to their customers life long. This will be continue till a human being will eat food. This income also will be continue (Repurchase) till human being live on earth.
WHERE IS COMPULSARY RETURNING MONEY (PROMISE TO PAY SYSTEM) AS SAID IN PRIZE CHITS ACT? WHERE IS EASY MONEY? WHERE IS QUICK MONEY?
Finally, Management of NMart is more interested to Prove this by legal way. Legal Department is also in favor of public prosperity. Ministry is also in favor of public. NMart is also in favor of Public. Shyam also in favor of Public. We all are public. Thank you very much for spending this much time for my this message. Yours true friend. RAJU.
THANK YOU SHYAM FOR GIVEN ME THIS OPPORTUNITY.
OFCOURSE, I AM VISITING COURT OR ETC & OBSERVING THIS CASE. IF NECESSARY, I AM READY TO EXPLAIN MY STAND IN ANY PLACE FOR TRUTH.

Dear Shayam,
1) kerla goverment made guideline for direct selling industry now rajasthan goverment.

2) many countries having guideline even small country like BANGLADESH IS HAVING GUIDELINE FOR DIRECT SELLING INDUSTRY.

3) Their is big difference between legal companies and illegal pyramid schmes pls try to find out.

Shyam Sundar said...

Dear Mallappa, now you are talking like a sane man not insane like Peter.
Your argument defending NMart is great. But there are many loopholes. Your arguments would be shredded to pieces by the defense counsel.
OK. Only one question. If, you and your boss Gopal believe that this is a legal business, why did he run away from the judiciary spending his life like a fugitive.
Gopal knows that this argument would be torn to pieces by the judges themselves without the help from the defense counsel of Corporate Frauds Watch.
Gemini Techno also argued on the same lines in Andhra Pradesh High Court. Gemini Techno is Rajahmundry-based organisation which swindled several crores of rupees in the name of selling products of course in multilevel marketing model. We filed the implead petition in it but the judges did not give us a chance to present our case. They posed question after question and the counsel of Gemini Techno tucked the tail.
Whatever clever way you present your arguments, it is easy and quick money for the company and some of the upline members. That is why it is illegal.
Within a short span of two years, Gopal garnered Rs. 1400 crore and is it not easy and quick money.
Most of the upline members like you and Peter might get offended for stopping the scheme. It is for the welfare of the people by and large.

DEAR SHAYAM, 1400 cr may be the turnover not profit bcoz for last two years every custumer redeemed their 220 rs coupaons and distributors got comission for sale and more then 100 mall it all needs some cost

Dear Shyam, now I clearly understood that, you have an option to delete/add some matter as per your choice in our letters. Because I have posted a comment. But it was saying as FOR BLOGGER APPROVAL. So, same I have posted in some other's blogs.
Now you have displayed my blog. If you want to check it, just you open some other blogs for this same matter
corporateworldemployment.blogspot.in
you can see full message. Please dear friend, don't do like that. It indicates your partiality on your blog. So no meaning to create blogs as per your choice na. Anyway thank you.
Now you are also some how good guy. Ok. Regarding NMart, you are telling as NMart CMD has collected 1400Crores. Ofcourse, for this I agree with you. But he has not inserted in his pocket my dear friend. If he does, I will fight more than you. This is also you are experienced from me na friend. I have visited more than 28 malls for clarification. Still continuing my clarifications. He has invested in a good manner. Crores of Rupees in Malls,Logistics. I can give you detailed calculations. And he has opened 286 malls within 2 years. Maintaining stock, giving facilities like COUPON BENEFITS, CREDIT, EXCHANGE as per his commitment. Ofcourse not 100%. But reached 50 to 60% satisfied. And also invested crores of rupees for wear houses state wise, logistics for spot supply of stock, tie-up with direct manufacturers..... really amazing. If it would be continue, within 4 to 5 months, NMart would brake all records in Indian Retail Industry. That's why within this 2 years, company succeeded very well. But some loop poles are there in admin level. You also can suggest them. Already so many corporate retail malls are getting business down at where NMart malls are working. In this tough situation also company paying salaries to staff, adjusting mall rents etc. Really they are in good intention dear Shyam. Simply, if any Indian Retail Company want to cross Walmart business, that is possible 100% by NMart. I am not a worker for NMart nor NMart CMD is not boss for me. In this industry, no worker-no boss system.
But being a 3rd person, we can punish anybody or appreciate anybody without any relationship. Am I correct?
Dear Shyam, I am not requesting you. But ask you as a friend, leave all -ve thoughts on any one. Just you see this NMart in-detail, as a well wisher for truth, you take 10 to 15 days for your detail report. After collecting all this, we both sit together. Then we will share if need any clarifications. If you do this, your family, your children are also will get good lives by the grace of god. Because of now situations, so many children are starving, so many are committing to suicide, because, this is major source for atleast 2 time food for their family. School fee, daily needs etc. A normal below 10th educated also leading his family some what better by this opportunity. I saw these type of people so many families. CMD has given what he promised more than 60%. Because logistics has to set-right for 100% service. Still he is telling as he is ready to give every commitment. If he tells not impossible to give or ran away, then we accept it. Easily he can give every committed benefit. I am telling with my traditional business experience dear Shyam.
Expected your practical work with +way. If you want to ask any doubt, I will give my number. But no fighting. Because we both are representing for these starving families for our beloved India.

Mallappa, when I opened the blog for comments, it does not mean you could misuse your freedom. Some unscrupulous elements are misusing their freedom of expression by hurling abuses. Whatever I did so far, was only as per law. This I have made it amply clear. Some people say why I am not fighting against corruption or against bureaucrats or politicans. It is all part of the struggle to cleanse our society.
I strongly believe MLM is a menace and it should be routed out.
People who make fast money at the expense of others may not like my battle against MLM. But, they know what they are doing is illegal but still do it. That is their greed for easy and quick money
Mallappa, you rather wrongly came to a conclusion that I did not study NMart business model.
Kindly accept money won't grow on trees.
Just one question: From where the money do come to pay commission to the enrolling distributors. It is from the pockets of the new members. Then where do the money come from to give gifts like computers, motorcycles, cars and foreign trips. Don't you think these are all inducements to bring in more of your friends and relatives. The company is only making money you are all losers.
You say the money is reinvested. Helicopter or Rolls Royce are not reinvestment.
Because you have made wads of money by recruiting your friends and relatives, that does not mean, it is a good business opportunity.
This is no good business opportunity at all. This is a chain marketing system which would break sooner than later. Then a sizable number of people would lose all their hard-earned money. There is nothing like endless chain.
I am not here to convince you and I know you would not agree. Because you are also one of the links in the so-called infinite chain.
Just present your arguments in a judicial court and convince the judge. They are more open to listen to your arguments.

YES, DEFINITELY I AM READY TO EXPLAIN MOUTH TO MOUTH MARKETING STAND. IT IS NOT JUST MY STAND. IT IS A SYSTEM. BUT WE ARE NOT GETTING ANY INFORMATION THAT, WHAT IS GOING ON IN NMART CASES. ALL THESE 20 LAKH PEOPLE CANNOT PHONE TO OUR ADVOCATE DIRECTLY. OUR ADVOCATE ALSO CANNOT POST BLOGS LIKE YOU. THIS IS THE MAIN PROBLEM. THAT'S WHY ALL ARE WATCHING YOUR BLOG. BECAUSE YOU MAY BE OPPONENT TO THIS CASE, YOU MAY BE ENEMY TO THIS SYSTEM, BUT SOME TIMES ENEMY ALSO GIVES SOME THING DATA THAN FRIENDS. SO, HERE SO MANY PERSONS ARE READY TO ENTER IN THIS SUBJECT THROUGH LEGAL WAY, BUT LACK OF INFORMATION. ONE THING I CAN TELL YOU DEAR SHYAM, WE ARE NOT AFRAID OF POLICE OR JUDICIAL OR YOU. BECAUSE THESE ARE FOR PUBLIC FACILITY. WE ARE ALSO PUBLIC. IF ANY NEED OF OUR ENTRY, WE ARE READY.
DEAR SHYAM, IF WE THINK -VE, IT MEANS, MANAGEMENT IS RELAXED THROUGH YOUR COMPLIANT. ORDINARY PEOPLE ONLY ARE SUFFERING. SO, YOUR INTENTION IS NOT FULFILL NA. THEN HOW CAN YOU DETERMINE THIS FOR PUBLIC BENEFIT? THIS YOUR ANSWER IS MOST IMPORTANT FOR PUBLIC DEAR SHYAM.

As per the law, any person collecting money with a promise of good returns, need to obtain permission/s from SEBI, if the number of people exceeds 49. Do a check on how many people have invested in this scheme and whether it has all permissions in place????.

MDT 2 weeks ago in reply to R MALLAPPA RAJU
Thanks R MALLAPPA RAJU for your comments. Hope you are not replying on behalf of NMart. Whatever is written above about NMart is taken from its own site, in case you want to know. Also do read the fine prints in the company's disclaimer (posted above in the article). Here are some wisdom tips provided by those who had studied/ researched MLM schemes...
Many have left high-paying jobs to "pursue their dreams" in an MLM. Having been conned so dramatically, they do not easily admit defeat. It seems easier to cling to the bad dream in an increasing cycle of desperation to make the MLM work against all odds.
And it is saddening to see people being encouraged against all instinct and common sense to chase after an illusory "pot of gold," but what can be done?
......................................Supreme Court judgement to stop pyramids on their tracks. Section 2 (c) of the Prize Chits and Money Circulation Schemes (Banning) Act, 1978, specifically covers all schemes promising quick and easy money based on enrolment of new members.

The Supreme Court of India observed, in the case of Kuriachan Chacko and Ors. Vs. State of Kerala (JT2008(7)SC614) that promoters of the scheme (aka, pyramid) knew they were making ‘tall promises’ which would only work for some time. And, that they were operating on the basis that ‘Paul can be robbed to pay Peter’ but, “ultimately, when there is a large mass of Peters, they will be left in the lurch without any remedy as they would by then have been deceived and deprived of their money.” So the principle of what constitutes a dubious lure is enshrined in the statute and ratified by the apex court.

Why then do pyramid marketing schemes proliferate with impunity in India? Because, although there is a Union statute barring money circulation schemes, it is for state governments and the police to initiate action. And most pyramid schemes work to ensure that influential people in government and the police are part of their network. For instance, when City Limouzine, a Mumbai-based Ponzi scheme, folded up after three years, it was discovered that almost 6,000 policemen had been entrapped by its promise of high returns. Even Speak Asia, which has triggered a national furore, has been enrolling policemen. A worried police official in Mumbai has even started a blog to warn fellow officers not to be fooled by the scheme.

Over the past decade, the only decisive action against pyramid schemes has been initiated by the Andhra Pradesh police, mainly under DIG (deputy inspector-general) of police, VC Sajjanar. He went after Japan Life (which sold magnetic mattresses for a whopping Rs1.32 lakh), Gold Quest (sold what it claimed were two numismatic coins at Rs30,000) and a few others. The Orissa police also blocked a similar scheme that raised over Rs1,000 crore from the poorest villages not too far from the Bangladesh border. In many cases, they initiated action under the Money Circulation Act, along with Section 420 of the Indian Penal Code as well as relevant sections of the Drugs and Cosmetics Act, 1940, and the Drugs and Magic Remedies Objectionable (Advertisement) Act, 1954.

Clearly, with no blanket ban or registration and regulatory supervision, pyramid companies can operate freely until they collapse.

c guyz, how shekawat fooled u .....
Here's what ur company says under the disclaimer page on its EARLIER website: "The owner/owners of this website (www.NMart.co.in) inform the distributors and would-be distributors that there is no guarantee that anyone joining the system would make money. The system purely depends on the number of distributors joining the system and distributor referrals."
.....
In addition, NMart says that the payment would not be refunded under any circumstances.

Unfortunately, no one seems to be reading the fine print on the NMart Website. Most of the new distributors are blinded, or fooled by the lure to buy daily-need items from the company's retail chain, which may or may not be there in their local area. This also means that you not only have to enrol new distributors in your down line, but also continue to buy products from the retail chain.

NMart offers a return that works out to about four times the original investment over a period of 48 months, without taking into account other income like binary, spill-over or royalties. The highest income that a distributor can earn, as presented by the company, works out to Rs48 lakh, or 873 times of the original Rs5,500 invested and this is simply not possible.

'FRAUD Business' plan

According to information EARLIER available on the company's Website, anyone wanting to join the NMart Retail system or business plan, has to invest or deposit Rs5,500. The company provides 48 vouchers of Rs220 (it needs to be consumed each month over a period of four years), a 'smart' card, credit facility of Rs1,500 per month (provided you settle the bill by the 7th of the following month), and last but not the least, a bonus of Rs11,000, if at all you remain with the company (and continue to enrol new recruits and buy products from its shop) for 48 months. Not satisfied, yet? The company also promises to pay other incomes, like binary income, spill-over income, royalty and repurchase incomes.

For any two new joinees, on either your left or right leg or down line, you would get Rs600 as pair income for an unlimited depth. (But it is capped at 100 pairs, or a payment of Rs60,000 per week.) So, the company says, enrolling 8,000 new distributors below your rank can earn a binary income of Rs24 lakh. If your success percentage is just 1%, you could still earn Rs24,000 just as binary income!

It, however, does not mention that for this you still need to enrol 80 new people with an investment of Rs5,500 each, or a total Rs4.40 lakh, of which the company would pay you Rs24,000. That's about 5% only and it keeps the rest with itself! If this is not enough, then the company promises to pay you spill-over income, or Rs200, for every new joinee below your line for an unlimited depth. In addition to this, NMart also promises to pay royalty and repurchase income.HOW CAN IT PAY ROYALTY WHEN IT PRODUCES 0 ITEMS?????

The company projects an income of Rs48 lakh for a down line of 16,000 distributors, with 8,000 associates on the left and right legs, each earning Rs24 lakh. But the next presentation slide suggests that you to do 'smart work' and instead recruit your own family members (like your spouse and your mother) instead of outsiders, to you can keep all the money (Rs48 lakh + Rs24 lakh + Rs24 lakh = Rs96 lakh) within the family!

One must analyse the compensation plan to determine whether participants are paid from actual sales to customers and not from money received from new recruits. If participants are paid primarily from money received from new recruits, then the company is an illegal pyramid or Ponzi scheme. This is exactly what NMart is doing.

New rules for MLM/Direct Selling companies by Union Govt
“Model rules” are likely to be finalized in the next two weeks to check “fraudulent MLMs”, said two government officials with knowledge of the matter. Neither wanted to be identified as the rules haven’t been formally approved yet by the government.

“Although the (Prize Chits) Act already bans such schemes, there is nothing to effectively check those that are operating online and from outside India,” said the official. “Most concerned ministries and departments have already given their in-principle approval.”

The move comes as the government has detected an increasing focus by such schemes on people based in the north-east and West Bengal as well as their being marketed online by entities outside the country, in a bid to stay off the regulatory radar, unlike, say, Speak Asia Online, which was accused of defrauding people to the tune of Rs.2,300-2,400 crore by Mumbai Police last year. Speak Asia chief executive Manoj Kumar did not respond to text messages and phone calls.

Also, the plan to set up a new central regulator for MLMs has been shelved in favour of a system that will be policed by the states. The new rules will be in the nature of legal guidelines and operate under the Prize Chits and Money Circulation Schemes (Banning) Act 1978. The idea behind the new guidelines is to ensure there is clarity in the implementation of the money circulation Act (as the Prize Chits law is also known), especially among state governments, said the second government official. The economic offences wings of state police forces are not clear about how to implement the Act, and hence the new guidelines, the second official said.

“There is a great deal of overlap in regulations both at the Centre and the state. We want these things to be made clear,” he said. “Several big companies are operating these schemes under the guise of marketing products. The new rules will effectively check that.” He didn’t elaborate. Multi-level marketing companies typically operate under a business model that compensates people not only for the product sales they generate, but also for enrolling other sellers and creating a pyramid structure. This is illegal under Indian law, officials said.

Several key government arms have been involved in the framing of these guidelines, according to one of the officials cited above. They include the ministries of corporate affairs, consumer affairs and law, the department of financial services under the finance ministry, the Securities and Exchange Board of India (Sebi) and the Central Economic Intelligence Bureau (CEIB).

Information with various law enforcement agencies suggests there are at least 18 large MLM companies in the country with an annual turnover of Rs.4,000-5,000 crore, said the first official cited above, adding that these are estimates as there is no data available with the government.

“In the course of framing these guidelines, we came across some new trends. Such companies are aggressively targeting the north-east states and West Bengal,” the first official said. “And now, these schemes are being increasingly marketed online, by people based outside India.” This was in addition to the four southern states—Andhra Pradesh, Tamil Nadu, Karnataka and Kerala—where such schemes always are active, he said. At least 552 unregistered MLM schemes are currently under Sebi’s scanner, he said.

While no data was available on the number of people registered with these schemes, a recent investigation in Madhya Pradesh showed that out of 31 MLM networks in the state, the top three had 2.1 million members.

“This data is indicative of the fact that throughout the country, millions could be enrolled as members with such schemes,” he said. Earlier this year, the Serious Fraud Investigation Office (SFIO) had recommended that the central government set up a regulatory body for MLM companies that would work in conjunction with the Enforcement Directorate and the Intelligence Bureau.

Hi,every body.I just couldnt resist myself to ask you some question....Mr. MALLAPPA RAJU as I think you are quite aware & knowledgeable of the MLM business and the rules abide by.
1ST Q.What is the profit NMART is earning from the selling of products?

2ND Q.Is this sufficient enough to disburse all the commissions & expenditures?

3RD Q.Is NMART disburse the commissions of the senior line ups from the money are being deposited as registration fee?

4TH Q.If NMART doing as 3RD Q then somehow the process 1:2 leads towards number indefinite. Then how can this business model be viable? What will happen with the last level joiners? Because law of average or 80:20 rules or any such rules which based on success rate can not or should not be legal in terms of monitory transactions where it is mathematically proved to be broken(as it much higher than birth rate)after some time. Don't you agree? If not please let me know as I may not be aware of any other equations(Please dont add emotional equations in it).
